Penalty method and triangular mesh

Default Penalty method and triangular mesh

I am a chemical engineer and lately i have been reading about finite elements to compute stokes flow problems. As far as i understand, implementing reduced integration penalty (RIP) method approach using linear triangular mesh may lead to trivial solution. So is it true that one should never use linear triangular mesh?

Any leads on this will be highly appreciated.
